Software Alliance Trademark Usage Guidelines
This is a statement of the OAI’s policy and guidelines relating to the use of trademarks owned by the Alliance. Your use of any Alliance trademark must be in accordance with this policy.
OAI “trademarks” include: OpenAirInterface
For this policy, “trademarks” or “marks” include all trade names, trade and service marks, and logos owned by the OpenAirInterface™ (OAI) Software Alliance.
Trademarks are used to identify and distinguish Alliance projects, workgroups, products, and services, and to assure the community of their quality and consistency. This policy is intended to balance two objectives:
- Protecting Alliance trademarks as reliable indicators of the qualities they represent; and
- Allowing community members and third parties to make fair and accurate references to Alliance projects, workgroups, and related products or services.
Trademarks are distinct from copyrights. A trademark grants its owner the exclusive right to control its use. Permission to use an Alliance trademark is governed solely by this policy and by the applicable statement of permitted use published on the website of the relevant project or workgroup.
A copyright license, including an open source license, does not grant any right or license to use Alliance trademarks. While open source licenses permit the modification and redistribution of copyrighted software, the right to use Alliance trademarks is independent of those rights and is subject to specific conditions designed to protect the integrity and reputation of the mark. These conditions are set out in the applicable statement of permitted use.
Any use of Alliance trademarks must comply with this policy. Misleading uses, implying endorsement or affiliation where none exists, or involving marks that are confusingly similar to Alliance trademarks are prohibited. All use of Alliance trademarks, and any goodwill arising from such use, shall inure exclusively to the benefit of the Alliance.
General Rules Applicable to All Trademarks
Some fundamental rules apply to the use of any trademark or service mark that you do not own, including any marks owned by the OpenAirInterface™ (OAI) Software Alliance (the « Alliance »), without the express permission of the owner.
Some uses of trademarks are also permitted under principles commonly known as “fair use,” and the Alliance does not seek to restrict those rights. You may make fair use of Alliance word marks in true factual statements or nominative references. However, fair use does not extend to statements or implications that the Alliance produces, endorses, or supports your company, products, or services. Even in fair use contexts, you should acknowledge the owner of the trademark with an appropriate notice, such as the one displayed onthe OAI workgroup or project websites.
- A trademark should always be used as an adjective modifying a generic noun, and never as a noun or verb.
- A trademark should not be used in the plural or possessive form.
- A trademark should not be altered, modified, or abbreviated in any way. Do not combine it with other terms, hyphenate it, or display it in parts. A multi-word trademark should not be compressed into a single word. Logos should not be displayed with color variations or with additional elements superimposed over them.
- A trademark should not be used as or incorporated into a domain name.
- A trademark should not be used as part of a product or service name.
- A trademark should not be incorporated into company logos or designs.
- An appropriate trademark notice (such as ™) should be used on the first or most prominent appearance of each Alliance mark, and the notice should not be altered. In particular, do not change a ™ symbol to ® unless you are the owner. If you are uncertain about the registration status of an Alliance mark in your jurisdiction, please contact us for guidance on the appropriate symbol.

When using OAI-owned trademarks, please follow these guidelines:

You may also use an Alliance mark or logo as a link to the relevant workgroup homepage or an official Alliance webpage, provided the usage preserves the goodwill and value of the mark and uses the official logo.

- <Alliance mark> <Your product name>
- <Alliance mark>-<Your product name>
Disclaimer
The Alliance does not make any express or implied warranties, including but not limited to warranties of non-infringement of any third-party intellectual property rights. The Alliance does not warrant that any pending trademark applications for Alliance trademarks will result in granted trademark protection. The Alliance shall not be liable for any claims relating to a user’s activities falling within the scope of the permission, and the user hereby agrees to indemnify, defend, and hold the Alliance and its contributors harmless against any such claims.
Updates
OAI may release new versions of this Alliance trademark policy or statements of permitted use of Alliance marks from time to time without notice.
