This privacy notice is designed to explain OpenAirInterface Software Alliance (OSA) policies and procedures with respect of collection, use and disclosure by OSA of personal information in connection with the Site.  This privacy notice has a limited scope and applies only to the Site.

It is OSA’s general policy to comply with the privacy legislation within each jurisdiction in which we operate. Privacy legislation or an individual’s right to privacy may differ from one jurisdiction to another. The rights and obligations described in this privacy notice may not apply to all individuals or in all jurisdictions.

WHAT PERSONAL INFORMATION IS COLLECTED THROUGH THE SITE?

OSA collects and maintains different types of personal information in connection with the Site including:

  • contact and identification information, such as name, address, telephone number and email address;
  • business relationship information, including information related to agreements, feedback and information requested or provided by or from you;
  • information related to our media, member and public relations activities;

HOW IS PERSONAL INFORMATION COLLECTED THROUGH THE SITE?

In general, you can visit the Site without telling us who you are or providing us with any personal information. There are portions of the Site where we may ask to collect personal information from you for a specific purpose, such as to provide you with information requested by you or carry out a transaction requested by you. You are not required to provide this personal information to us. However, if you choose not to, we may not be able to complete your requested transaction or provide you with the requested information.

We collect certain non-personal information about visitors to the Site, including the pages viewed, the links clicked, and other actions taken within the Site. HOW DOES OSA USE PERSONAL INFORMATION?

OSA collects personal information to enable us to manage and develop our business and operations, including:

  • to improve our security measures;
  • to enable us to undertake our environmental, health and safety activities, including incident planning, response and investigation;

HOW DOES OSA DISCLOSE PERSONAL INFORMATION?

We share your personal information with our employees, contractors, consultants and other parties who require such information to assist us with establishing, maintaining and managing our business relationship with you, including: third parties that provide services to us or on our behalf; third parties that collaborate with OSA in the provision of services to you; and, third parties whose services we use to conduct our business.

Further, personal information may be disclosed:

  • as permitted or required by applicable law or regulatory requirements, in which case, we will endeavor to not disclose more personal information than is required under the circumstances;
  • to comply with valid legal processes such as search warrants, subpoenas or court orders;
  • to protect the rights and property of OSA;

HOW DOES OSA PROTECT PERSONAL INFORMATION?

OSA endeavors to maintain adequate physical, procedural and technical security with respect to its offices and information storage facilities so as to prevent any loss, misuse, unauthorized access, disclosure, or modification of personal information.

As part of those precautions, OSA endeavors to restrict access to personal information to those employees and others (i.e. individuals or organizations providing services to OSA) that it determines need to know that information in order that OSA  may conduct its activities.

HOW TO ACCESS AND UPDATE YOUR PERSONAL INFORMATION

OSA endeavors to ensure that any personal information in its possession is as accurate, current and complete as necessary for the purposes for which OSA uses that information. If you want to review, verify or correct your personal information, please contact us. Please note that any such communication must be in writing.

When requesting access to your personal information, please note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with the personal information that we hold about you. If you require assistance in preparing your request, please contact us.

Your right to access the personal information that we hold about you is not absolute. For example, there are instances where your personal information may have been destroyed, erased or made anonymous. In addition, there are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In the event that we cannot provide you with access to your personal information, we will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.

To some extent, OSA relies on individuals to update their own personal information. For example, if an individual has had a change of address or telephone number, the individual should complete the appropriate documentation and forward to the appropriate contact within OSA requesting that the individual’s file be updated. Unless an individual advises OSA of these important changes, OSA may have no way of knowing about them.

OSA reserves the right not to change any personal information and instead append any alternative information the individual concerned believes is appropriate. For example, OSA may not change certain information contained in a lease administration file, but will attach a sheet to that file indicating the amendment requested by the individual.

OTHER MATTERS RELATED TO OUR SITE

This privacy notice does not apply to any website other than our Site.  Our Site contains links to other websites that OSA does not own or control and we cannot be responsible for the privacy policies and practices of those websites.  Similarly, we cannot be responsible for the privacy policies and practices of any website from which you linked to our Site.  We encourage you to read the privacy policies of each and every third party website and to be aware when you leave our Site.

Please be aware that, by visiting our Site, you acknowledge that our servers are currently located in France and that the various communications necessarily result in the transfer of information across international boundaries.

Personal information collected on our Site may be stored and processed in France or any other country in which we maintain facilities. OSA may from time to time make changes to this privacy notice to reflect changes in its legal or regulatory obligations or in the manner in which it deals with your personal information. We will post any revised version of this privacy notice on our website www.openairinterface.org, and we encourage you to refer back to it on a regular basis. Any changes to this privacy notice will be effective from the time they are posted, provided that any change that relates to why we collect, use or disclose your personal information will not apply to you, where your consent is required to such collection, use or disclosure, until we have obtained your consent to such change.
